Development Application Minimum Requirements
In 2025, SB 1080 (Local Government Land Regulations) was approved, amending Florida Statutes 166.033 (Development Permits and Orders) to read:
- A municipality shall specify in writing the minimum information that must be submitted for an application for a zoning approval, rezoning approval, subdivision approval, certification, special exception, or variance. A municipality shall make the minimum information available for inspection and copying at the location where the municipality receives applications for development permits and orders, provide the information to the applicant at a preapplication meeting, or post the information on the municipality’s website.
SB 1080 has an effective date of October 1, 2025. To comply with this requirement, Indian Harbour Beach presents the following minimum information.
Required Documents
Zoning/Rezoning
- Affidavit of Ownership
- Legal Description
- Recorded Property Deed
- Cover letter describing the rezoning request, including a narrative describing how the request relates to the statements for review in Code of Ordinances, Appendix A, Article XIX(1)
- Non-binding concept plan containing items listed in Code of Ordinances, Appendix A, Article XIX(3)
- Property owner mailing list (500’ buffer)
- Proposed schedule for community engagement
- Authorization to Represent, if applicable
- Survey, if applicable
Subdivision
- See Florida Statutes, Chapter 177, Part I related to Platting for all minimum requirements related to the subdivision of land. Of note:
- Boundary Survey
- Title Opinion
- Name of Subdivision
- Plat or replat prepared and signed by professional surveyor and mapper, complying with Florida Statutes, Section 177.091
- In addition, the following minimum information is required:
- Affidavit of Ownership
- Authorization to Represent, if applicable
- Minimum standards at the city level can be found in Code of Ordinances, Appendix B, Chapter 103, Section 103-3 (Preliminary Plat) and Section 103-5 (Final Plat)
- Engineered construction drawings, stormwater plan, if applicable
- Bond for subdivision improvements, if applicable
- Protective covenants, if applicable
Special Exception or Conditional Use
- Affidavit of Ownership (of each and every owner of said lands)
- Legal Description
- Recorded Property Deed
- Cover letter describing the conditional land use or special exception desired and the reason for the request, plus a narrative of how the request meets the 12 conditional use/special exception burdens of proof listed in Code of Ordinances, Appendix A, Article XIV, Section 2.
- Complete application for Preliminary Site Plan in accordance with Code of Ordinances, Appendix B, Chapter 104, Section 104-3
- Property owner mailing list (250’ buffer)
- Authorization to Represent, if applicable
- Survey, if applicable
Variance
- Full information and documentation showing the nature of the hardship which creates the need for the variance, the cause or origin of such hardship, the reasons why the variance is sought, all dimensions and other data necessary to show that the variance being requested is the minimum variance which will relieve the alleged hardship, and any other relevant information
- Cover letter describing the above, plus a narrative of how the request meets the five Variance Requirements listed in Code of Ordinances, Appendix A, Article XVI, Section 2(A)(1)-(5)

- Legal Description
- Authorization to Represent, if applicable
